Terms of Use

These Terms of Use govern exclusively access to and use of the platform. Pricing, billing and subscription terms are set out in the Terms of Sale.
1. Purpose and scope
These Terms of Use (hereinafter the « Terms ») define the conditions for accessing and using the SaaS platform CaveauFlow, available at app.caveauflow.com, published by CaveauFlow, a French simplified joint-stock company with a sole shareholder (SASU) with share capital of 50 euros, company number 107 484 222 (Paris Trade and Companies Register), registered office 47 rue Vivienne, 75002 Paris (hereinafter the « Publisher »).
CaveauFlow is intended exclusively for professionals (restaurateurs, hoteliers, wine merchants and any professional in the restaurant and hotel industry), hereinafter the « User ». Any use implies unreserved acceptance of these Terms.
These Terms apply independently of the Terms of Sale. In the event of a contradiction between the two documents, the Terms of Sale prevail on the matters they govern.
2. Access to the service
Access to CaveauFlow requires the creation of an account with a valid email address. The User warrants the accuracy of the information provided and undertakes to keep it up to date.
The User is solely responsible for keeping their login credentials confidential. They must use a strong password (at least 12 characters, combining upper case, lower case, digits and special characters) and must not share it with third parties.
If fraudulent access or a compromise of credentials is suspected, the User undertakes to inform the Publisher immediately at security@caveauflow.com. The Publisher cannot be held liable for the consequences of unauthorised access resulting from a breach of this obligation.
The Publisher reserves the right to suspend or terminate any account in the event of a breach of these Terms, fraudulent use, or in accordance with the Terms of Sale.
3. Description of the service
CaveauFlow provides the following features, depending on the plan subscribed to:
- Import and analysis of supplier listings (PDF, Excel) by artificial intelligence
- Building and managing a dynamic product database
- Assisted stock counts with purchase prices pre-filled
- Generating, customising and exporting wine lists
- Managing stock alerts and supplier orders
- Margin analysis and periodic reports
- Integration with POS systems (depending on plan)
The Publisher reserves the right to change the features. Additions are deployed without notice. The removal of significant features is notified by email with 30 days' notice, save for a mandatory technical or legal constraint.
4. Availability of the service
The Publisher endeavours to ensure continuous availability of the service. No minimum availability commitment (SLA) is guaranteed under these Terms, unless expressly stated otherwise in the Terms of Sale or in a specific contract signed with the User.
Planned interruptions for maintenance may occur. The Publisher endeavours to inform Users within a reasonable time where possible. In the event of a technical or security emergency, an interruption may occur without notice.
CaveauFlow depends on third-party services (cloud infrastructure, artificial intelligence APIs, payment providers, email delivery service). Some features may be temporarily unavailable if those third-party services fail, without the Publisher incurring any liability in that respect.
5. User obligations and responsibilities
The User undertakes to:
- Use the service only for lawful professional purposes
- Not attempt to circumvent, compromise or test the security measures
- Not reverse engineer, decompile or disassemble the software
- Not extract data from the platform on a large scale by scraping or automated means
- Not reproduce, copy, resell or commercially exploit all or part of the service
- Not import content that infringes third-party rights or applicable regulations
- Not share their credentials with third parties not authorised by their subscription plan
- Comply with the usage quotas set by the plan subscribed to
The User is solely responsible for the data they import, enter or generate through the platform. They warrant that they hold all the rights necessary over that data.
6. Artificial intelligence: document processing
CaveauFlow uses Anthropic's Claude API to analyse imported documents (invoices, supplier listings, labels). The data sent to that API is processed in accordance with Anthropic's contractual commitments to the Publisher.
Data processed through the Anthropic API is not used by the Publisher to train its own artificial intelligence models. The processing carried out by Anthropic is governed by that provider's contractual commitments, in particular its Data Processing Agreement and its API Terms of Service.
Results produced by AI are provided for guidance only. The User is responsible for checking and validating the extracted data before any use. The Publisher is not responsible for automatic extraction errors.
7. Managing supplier orders
The CaveauFlow ordering feature is a transmission tool allowing the User to generate and send purchase orders to their suppliers.
The Publisher is in no way a party to the contract entered into between the User and their suppliers. CaveauFlow acts as a mere technical intermediary for transmission, and is neither a co-contractor nor an agent, nor responsible for the performance of orders, deliveries, or disputes between the User and their suppliers.
The User is solely responsible for checking that their suppliers have properly received the orders and for their performance.
8. User data, export and account deletion
The User remains the owner of all the data they import or create in CaveauFlow (supplier listings, products, stock counts, wine lists).
Data export: the User may at any time export all of their business data from their account area (« Account » / « Data » section), in CSV or JSON format, or request it at privacy@caveauflow.com (processed within 5 business days).
Account deletion: the User may request the deletion of their account and their personal data at any time from their account area or by email. The data is then permanently deleted within 30 days, unless a legal obligation requires longer retention (in particular billing data, retained for 10 years).

9. Intellectual property
CaveauFlow, its interface, its algorithms, its source code, its designs and any associated documentation are the exclusive property of CaveauFlow or are the subject of licences granted to it.
Use of the service confers on the User no intellectual property right over the components of the platform. The following are expressly prohibited: reproduction, representation, modification, extraction, adaptation, resale, sub-licensing, reverse engineering, decompilation or any act of exploitation not expressly authorised.
The User grants the Publisher a non-exclusive, worldwide and royalty-free licence to host, process and return the data they import, for the sole purpose of providing the contractually agreed service.
10. Limitation of liability
The Publisher uses all reasonable means to ensure the availability and reliability of the service. Its liability may only be incurred for direct damage resulting from a proven fault directly caused by the service.
The following are expressly excluded from the Publisher's liability:
- Data losses resulting from use that does not comply with these Terms
- Automatic extraction errors by artificial intelligence
- Malfunctions attributable to third-party services (cloud, API, email)
- Loss of business, loss of profit or indirect damage
- The consequences of unauthorised access resulting from a breach by the User
- The non-performance of supplier orders passing through the platform
The Publisher's total liability is capped at the amounts actually paid by the User over the 12 months preceding the loss.
11. Force majeure
The Publisher cannot be held liable for the partial or total non-performance of its obligations in the event of force majeure or an unforeseeable event beyond its control, in particular:
- Failure or unavailability of cloud infrastructure (AWS, Vercel)
- Interruption or modification of the third-party APIs used (Anthropic, Stripe)
- Cyberattacks, DDoS attacks or major security incidents
- Natural disasters, pandemics, armed conflicts
- Government or regulatory decisions requiring a service interruption
- Widespread telecommunications network outages
In the event of force majeure, the Publisher will inform the User as soon as possible and will use reasonable means to restore the service.
12. Support and assistance
The Publisher provides technical support on the following terms:
- Email support: support@caveauflow.com, target response time: 2 business days
- Critical bugs (service completely inaccessible): priority handling within 8 business hours
- Priority support: available on certain plans under the Terms of Sale
- Documentation: available online to all Users
These times are targets and do not constitute firm contractual commitments, unless stated otherwise in the Terms of Sale.
13. Changes to the Terms
The Publisher may amend these Terms at any time. In the event of a substantial change, the User will be informed by email with 30 days' notice. Minor changes (corrections, clarifications with no impact on Users' rights) take effect immediately upon publication.
Continuing to use the service after the notice period has expired constitutes acceptance of the new Terms. Failing that, the User may terminate their subscription free of charge within that period.
14. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution within 60 days of the written notification of the disagreement.
Failing an amicable resolution, the dispute will be brought before the Paris Economic Activities Court, unless a mandatory legal provision states otherwise.
